Chapter 7 Amendment to Schedules

The debtor must amend schedules to:

  • add a new creditor
  • add an address for a creditor that was previously listed with no address or an incomplete address
  • remove a creditor
  • change the amount of a debt
  • change the classification of a debt

The debtor must also amend the list of creditors (the "Matrix") when an amendment to the schedules:

  • adds a new creditor
  • adds an address for a creditor that was previously listed with no address or an incomplete address.
  • removes a creditor

An amendment fee is due when amending schedules D, E/F, or the Matrix. The ECF system will access a filing fee for each filing. To avoid multiple charges, the filer must file the amended schedules and the Matrix as one transaction (filing)

Requirements:

When adding a creditor, the debtor must use the court's local form notice. Local Forms MSSB-A7-1 and MSSB-A7-2. See Miss. Bankr. L.R. 1009-1(a)

No creditor added, the debtor must give notice of the amendment to the trustee and affected entity. See Fed. R. Bankr. P. 1009(a). There is no local form notice when not adding a creditor.

The ECF system will access a filing fee for each filing. The filer must docket the amended schedules and matrix as one transaction (filing) to avoid multiple charges.
