Convert Chapter 7 Case to Chapter 11, 12, or 13

Chapter 7 to Chapter 11

At any time, the debtor may convert a case from a chapter 7 to a chapter 11 provided the case has not previously converted from a chapter 11, 12, or 13. See 11 U.S.C. § 706(a)

After notice and a hearing, the court may convert a case from a chapter 7 to a chapter 11 at the request of an interested party. 11 U.S.C. § 706(b)

Request by Debtor

When the court grants the debtor's motion, they must pay a conversion fee.

A chapter 7 debtor may request to convert to a case under chapter 12 at any time. The Court may not convert a case from chapter 7 to chapter 12 unless the debtor requests or consents to the conversion.

Chapter 7 to Chapter 13 request by the Debtor

A chapter 7 debtor may request to convert to a case under chapter 13 at any time. The Court may not convert a case from chapter 7 to chapter 13 unless the debtor requests or consents to the conversion.

The debtor must file a chapter 13 plan no later than 14 days after entry of the conversion order. See Notice to File Chapter 13 Plan and Fed. R. Bankr. P. 3015(b).
