Chapter 11 First Day Motions

01/25/2024

Miss. Bankr. L.R. 9013-1(f)-(g)

A First Day Motion is defined as any motion or application in which the debtor requests a hearing or the entry of an order on an expedited basis as defined in Miss. Bankr. L.R. 9013-1(f) before the earlier of the creditors' committee formation meeting or the 11 U.S.C. § 341 meeting of creditors. See Miss. Bankr. L.R. 9013-1(g)(1)

Generally, a first-day motion is filed on the same day the voluntary petition is filed. Once the case is filed, counsel for the debtor must contact the judge’s chambers to schedule the motion(s) for a hearing. See Miss. Bankr. L.R. 9013-1(g)(3)
