Motion to Waive Chapter 13 Discharge

11 U.S.C. § 1328

In the following instances, the debtor or debtor's attorney will file a motion to waive the discharge when the debtor received a discharge in a case filed under:

  • Chapter 7, 11, or 12 during the four years preceding the file date of the new chapter 13. See 11 U.S.C. § 1328(f)(1); or
  • Chapter 13 during the two years preceding the file date of the new chapter 13 case 11 U.S.C. § 1328(f)(2).
