Application to Waive Chapter 7 Filing Fee

An individual debtor may file an application to waive the filing fee along with the bankruptcy petition. The application must be prepared as prescribed by the appropriate Official Form 103B Application to Have the Chapter 7 Filing Fee Waived.

The court may waive the Chapter 7 filing fee if the court determines that the individual debtor:

  • has income less than 150 percent of the income official poverty line applicable to a family of the size involved; and (click here to view the poverty guidelines).
  • is unable to pay that fee in installments.
