Motion for Authority to Obtain Credit

11 U.S.C. § 364

Motions for authority to obtain credit must include a copy of the credit agreement and a proposed order. See Fed. R. Bank. P. 4001(c)(1)(A).

11 U.S.C. § 364 applies when the trustee is authorized to run the business of the debtor for a case under chapter 7, 11, 12, and 13.

Note: Rule 4001(c) does not apply in a chapter 13 case. See Fed. R. Bank. P. 4001(c)(4). For a chapter 13 debtor who is not self-employed, see Motion to Incur Debt or Motion to Borrow.
