Motion to Declare Lien Satisfied

Fed. R. Bankr. P. 5009(d)

A Chapter 12 or Chapter 13 debtor may file a motion requesting entry of an order declaring that the secured claim has been satisfied and the lien has been released under the terms of a confirmed plan.

The Debtor must serve the motion and notice on the holder of the claim and any other entity the court designates in the manner provided by Rule 7004 for service of a summons and complaint.

Important: Effective March 15, 2024, the movant must add the lienholder as a party to the case during the docketing process for the motion.
