Alias Summons

Fed. R. Bankr. P. 7004

If a Court issued Summons in an adversary proceeding is not served within the time allowed by the Federal Rules*, an e-filer may submit a request for the court to issue a new Summons (a/k/a Alias Summons). The clerk will generate and docket the Alias Summons and electronically transmit it to the plaintiff's attorney (via NEF).

*7 days after the clerk issues the summons. The 7-day time period does not apply to service in a foreign country. See Fed. R. Bankr. P. 7004(e)

The above event does not require a PDF document.

CA Procedures

Step 1. Prepare Alias Summons

See instructions for preparing summons

If applicable, obtain new pre-trial conference date.

Step 2. Docket Alias Summons

Docket Event:

[Adversary > Court Events > Alias Summons Issued]

When the system generates a summons, skip the upload screen (do not upload a PDF file/document); Click Next

Select the Party the plaintiff is required to serve; Click Next

Date summons issued; input/select current date. Answer due date automatically populates; Click Next
Verify docket text; Click Next
Click Next
Select - advsum1 – AdvSummons2500A; Click Next

*Form AdvSummons2500A Screen:

From the Case participants list, select the Plaintiff’s attorney; Click Next

*Note: A case participant selection is required. When a selected case participant is an ECF user (receives NEF’s) BNC will not mail the form. Instead the certificate of mailing from BNC will state the party received notice at the email address of record in the ECF system.

To send a summons to a party not listed in the case participants list or to a case participant listed with no address, check the box for [Additional recipients]; complete the name and address fields; and Click [Add recipient]; Click Next.

Complete CM/ECF form (see below)
At the bottom of the 2nd page Click Submit
NEF screen appears; Click Next
